CONDITIONS OF RENTAL MATERIAL DECORATION

Below are the general rental conditions which present the rights and obligations of the owner (Maison Ditaba) and the tenant, within the framework of the rental of the decoration equipment held by Maison Ditaba and carried out on the site www.maisonditaba.fr. These conditions determine all the phases necessary for the progress, the follow-up of the order and the proper deployment of the service.

Maison Ditaba's decorative material consists of handcrafted, second-hand, vintage or manufactured items. It is therefore rented as is. The rental of these decorative objects implies, on the part of any tenant, the acceptance and full awareness of the wear and tear of the object, its age and its fragility.

Maison Ditaba reserves the right to change these general conditions of sale at any time. In the event of a change, the general conditions of sale in force will be applied to each rental, on the day the order is placed.

Definition of the rental service

The rental service, is a provision of decorative equipment held by Maison Ditaba, from a place defined by Maison Ditaba, within the framework of a removal by the tenant. The provision excludes any other intervention.

Booking process

Your visit to the site www.maisonditaba.fr automatically makes you accept the general rental conditions of the site named above. For make your reservation :

By clicking on “I reserve” to send us your information, a confirmation email is automatically sent to you,
We will then contact you again, to confirm or not the availability of the reserved objects and to confirm with you the quote,
The reservation is confirmed when you have accepted the quote, which acts as a signed contract and paid the first deposit.

Note: to reserve other objects, the same process is applicable, unless agreed between the two parties (owner and tenant). A single quote will be made for the rental of several objects, subject to availability.

Price

The prices are indicated in euros all taxes included (TTC). The price indicated is that invoiced and in force at the time of registration of your order. This can be the unit price or the wholesale price. Depending on the quantity ordered, the price may therefore be decreasing.

Payment process and cancellation

As said above, a deposit of 50% of the total amount of the order will be requested from you, so that your reservation is confirmed. In the event of cancellation, there will be no refund of this deposit unless you exercise the right of withdrawal. Cancellation is possible up to 48 hours maximum before the day of withdrawal. It is validated by written agreement, by means of a cancellation email or SMS, sent by the owner (Maison Ditaba) to the tenant. If the tenant wishes to cancel his cancellation, the reservation process mentioned above will have to be redone, unless there is a written or tacit agreement between the owner and the tenant. The first deposit is made only by bank transfer, except in cases of force majeure (cheque, cash) and with written agreement between the two parties.

Upon receipt of the deposit, it is automatically cashed. The rest of the payment (bank transfer or cash except in cases of force majeure and with tacit agreement between the two parties) is made on the day of collection of the rented decorative objects. An invoice is then sent to you, when the final payment is made on your part.

Bail

On the day of the removal of the decorative objects, a deposit will be requested. This must be done by a check which will not be cashed, subject to compliance with the rental conditions of the owner Maison Ditaba. The amount of the check is fixed and will be sent to you if you decide to reserve the rental equipment.

In the event of no damage observed on the rented decoration material (after verification by Maison Ditaba), your check will be destroyed or returned to you.

Duration location

The rental is effective when you collect the goods from a place defined by Maison Ditaba. Its duration cannot exceed 4 full days, except in cases of force majeure, and after mutual and written agreement between the two parties.

Withdrawal from the order

The material is under your responsibility, as soon as you remove it. If you choose to use a carrier or a third party appointed by you, Maison Ditaba is in no way responsible. The carrier or the third party accepts the equipment as is and no recourse is possible if the equipment chosen does not ultimately meet your needs.

Legal custody

At the time of the withdrawal of the decorative material, according to the provisions of article 1384 of the civil code, you become entirely responsible for the material and the material and legal custody of the rented decorative objects is transferred to you. Whether or not you have insurance, you assume all direct or indirect consequences of any event occurring during the rental period.

Obligations of the tenant and use of decorative objects

You certify that you have sufficient training to make correct use of the rented equipment and you agree to comply with the safety rules and precautions for use. The rented equipment must be used under normal conditions and in their intended purpose. The equipment will be tested before departure by Maison Ditaba (owner of the equipment) in the presence of the tenant, this implies for the tenant that he accepts the perfect working order of it.

Being responsible for the equipment, as soon as it leaves the owner (Maison Ditaba), it is your responsibility to return the rented equipment to Maison Ditaba in its initial state of cleanliness.

In the event of non-compliance with this, a deduction per object will be deducted from your deposit for each object not returned in its initial state of cleanliness: 40 cents of euros per article for small objects (ex: table runner), 2 euros for the medium (ex: vase), 5 euros for large objects (ex: carpet) and 15 euros for even larger ones (ex: arch).

You accept the material as is. If it does not ultimately meet your needs and expectations, no recourse will be possible. It is recommended that the tenant to insure all risks on the rented equipment (vandalism, disasters natural disasters, bodily and material damage, etc.), with his insurance company. The tenant is assumed to know the operation and handling of the material, he will therefore be held responsible for any misuse. The lessee certifies that he is aware of all the safety warnings, risks and precautions to be taken relating to the use of the equipment rented by means of this present quote. Under no circumstances can the owner (Maison Ditaba) be held liable for any bodily injury or material damage resulting from the use of his equipment by the tenant having accepted the perfect working order of the equipment by accepting the quote.

Return of material and delay

The return of each item must be in its original packaging. A quantitative and qualitative control is carried out in your presence or of a third person that you have appointed, when the equipment is returned. The equipment will be checked from a place defined by Maison Ditaba, when it is returned. A pre-verification to be carried out on your side is recommended. In the absence of the tenant or the authorized third party, the observations made by Maison Ditaba will be the only ones taken into account for the invoicing of any missing items. Any cleaning, defect, irregularity, or excessive wear in relation to the determined use, may give rise to the collection of the deposit in proportion to the damage suffered by the equipment. The equipment to be repaired will thus be repaired by the owner (Maison Ditaba) or any other, with an invoice payable by the tenant, by means of the deposit check. For these two cases, the check will be fully cashed in the Maison Ditaba bank account, then a refund will be made, on a pro rata basis, by bank transfer to the tenant's bank account.

If you exceed the deadline set for returning the goods to us, late payment penalties equivalent to 20% of the total amount of your order will be due per day of delay. These will be deducted from the deposit check.

Right to retract

In accordance with article L121-19-1 of the Consumer Code, you have a withdrawal period of 48 hours from the confirmation of the order.

Personal information and protection of personal data

Maison Ditaba undertakes to respect its privacy policy .

Applicable right

In the event of a dispute, an amicable solution will be sought before any legal action. The prior search for an amicable solution does not interrupt the deadlines for acting as a guarantee.

If no amicable solution is found, only the courts of Meaux are competent.
